1  Acceptance 

Your access to and use of Linkit Solutions (Pty) Ltd. website is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website, you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions, you must immediately stop using the Website.

The contents of Linkit Solutions (Pty) Ltd. website do not constitute advice and should not be relied upon in making or refraining from making any decision.

3 Use of the Website

3.1.4    Any attempt to gain unauthorised access to the Website or its related systems or networks;

3.1.5    Accessing the Website for purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purpose; and

3.1.6    The reverse engineering or decompiling of the Website.

3.2    When a client registers on the Website, they will be required to provide certain access details, including a username and a password. Clients are responsible for maintaining the confidentiality and security of your User Name and Password for access to the Website and accept full liability for all activities that occur on or involves the Website under a client’s User Name. Clients may not:

3.2.1    Allow other people to use their User Name and Password; or

3.2.2    Impersonate another User or any third party; or

3.2.3    Provide false information to gain access to the Website.

3.3    Clients warrant their identity (in other words, that they are who they say they are).

3.4    Although reasonable steps have been taken to ensure the accuracy and completeness of the contents, data and information on this Website, there may be instances where such information proves inaccurate or incomplete. Clients should take all reasonable steps to ensure and verify the accuracy of the contents, data and information obtained from this Website, especially if certain information appears to be inaccurate, particularly product pricing and promotional content.

Linkit Solutions (Pty) Ltd.  reserves the right to:
 

4.1      Change or remove (temporarily or permanently) the Website or any part of it without  

notice and you confirm that Linkit Solutions (Pty) Ltd. shall not be liable to you for any such change or removal and;

4.2      Change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

Linkit Solutions (Pty) Ltd. Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

6.1      All copyright, trade-marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Linkit Solutions (Pty) Ltd. or otherwise used by Linkit Solutions (Pty) Ltd. as permitted by law.

7  Disclaimers and Limitation of Liability

7.1      The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

7.2      To the extent permitted by law, Linkit Solutions (Pty) Ltd. will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.

7.3      Linkit Solutions (Pty) Ltd. makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

 

8  Indemnity

You agree to indemnify and hold Linkit Solutions (Pty) Ltd. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Linkit Solutions (Pty) Ltd. arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

9  Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

10  Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of South Africa and you hereby submit to the exclusive jurisdiction of the South African courts.

11  SMS Notifications

We may use your cellphone number for the exclusive purpose of transactional updates with regards to delivery or collection of orders you place on our website. We will not contact you via SMS related to any marketing matter.

12  Delivery Information

12.1    Most items listed on this website are not held in stock at our premises (unless otherwise stated) and are rather ordered from various suppliers as orders are placed. We will also give you an estimated delivery time. Certain items such as fully-assembled PCs may have a slightly longer lead-time (due to the fact that they'll need to be assembled and tested). Should any item not be in stock with our suppliers, we will contact you to suggest a substitute product. At this point, you may accept the substitute, place the item on backorder or cancel the item from your order.

12.2    You acknowledge that delivery dates given in advance are estimated and will be made subject to prior orders on file with Linkit Solutions (Pty) Ltd.  We will use our best endeavours to ensure that delivery is completed as soon as is reasonably possible after the estimated delivery date. Notwithstanding the aforegoing, We shall not be liable for failure to perform or delay in performance hereunder resulting from any cause beyond our control, such as fire, labour difficulties, transportation difficulties, interruptions in power supply (including but not limited to what may be termed "load shedding" or "black-outs") and delays in usual sources of supply, major changes in economic conditions, breakdown of machinery or any cause beyond our control, or whether caused by negligence or otherwise. 

12.3    Once the order has been confirmed, you can make payment through the Payfast system. The Payfast system allows for credit card and EFT payments. Orders will be placed with our suppliers once proof of payment has been received and in the case of EFT payments, the order will be shipped once the payment reflects in our bank account. 

Type of delivery

Door-to-door Courier 

NOTE: Door-to-door Couriers do not deliver to PO Boxes. Please provide a Street Address at checkout.

Your order will be delivered directly to your door. Please note that your order's weight is calculated using the higher value of actual or volumetric mass for each product. The delivery rate is calculated according to the total weight of the items in your cart, the total price of the cart as well as the destination address. To receive an estimate on the delivery charge, please enter your delivery details in the Estimate Delivery box on the Shopping Basket page.

What happens if I don't receive my order?
 

If your order is lost, damaged or stolen, we will either send you a replacement order or we will refund the full order to you. It's at our sole discretion to choose whether to replace or refund the order. 

If any parcel delivered by our couriers appears to be damaged, please be sure to verify both the contents and condition of the consignment in the presence of the courier driver. Phone us immediately if any product is damaged or missing. Liability for any shipments sent from us ends with the obtainment of a clean signature from the consignee upon delivery of the goods.

CANCELLATIONS, REFUNDS AND RETURNS

You may cancel a contract prior to a shipping notification being sent. Should an order be cancelled after a shipping notification has been sent a shipping fee will be deducted from the refund.

Returns Policy

If a client is not satisfied with a purchase, it can be returned within ten days of the delivery for a full refund, less the shipping costs. Full refunds will only be issued if products are returned unopened and with all packaging and any other materials that were part of the original purchase.

Should an opened item be returned without some or all of the original packaging and materials, Linkit Solutions (Pty) Ltd. reserves the right, at its sole discretion to levy an additional fee.

Goods returned in opened packaging need to be returned in a condition that is fit for resale. Should an opened product be returned, a 25% re-stocking fee will be charged, provided that all the original packaging and all materials are provided with it. Software and consumables can only be returned if they have not been opened.

All products being shipped back to Linkit Solutions (Pty) Ltd. should be carefully packed in protective materials where necessary. The package should have the order number and return address clearly marked. Should a product be damaged while being shipped to our offices; Linkit Solutions (Pty) Ltd. will not be liable for the damages. It is recommended to insure any items that you send to us.

A client may not return products that have been discounted, are on sale or that Linkit Solutions (Pty) Ltd. has been expressly or implicitly required or expected to procure, create or alter specifically to satisfy the client’s requirements

Replacements:
 

All products sold by Linkit Solutions (Pty) Ltd. are covered by the manufacturer's original warranty, which is at least 1 year from the date of order, unless otherwise stated. Some products have longer manufacturer warranties, and we honour these warranties as well.

Should you have a faulty item, contact us and we'll assist you by providing you with the details for the return process. In this case, the customer will be responsible for arranging delivery of the faulty item back to Linkit Solutions (Pty) Ltd.

Where we refer to “personal information”, it means “personal information” as defined in the Protection of Personal Information Act, 4 of 2013 (“POPI“).
